1. Services
McGuire Management provides a business management platform that includes CRM, lead management, unified inbox, invoicing, payment processing, review automation, appointment scheduling, and optional managed marketing services. Services are provided on a subscription basis.
2. Account Registration
To use our services, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.
3. Subscription and Payments
- Subscription fees are billed monthly or annually as selected at signup.
- All fees are non-refundable except as expressly stated in these Terms or required by law.
- We reserve the right to change pricing with 30 days' notice.
- Failure to pay may result in suspension or termination of your account.
4. Acceptable Use
You agree not to:
- Use our services for any unlawful purpose or in violation of any applicable law
- Send unsolicited messages (spam) through our platform
- Transmit any material that is harmful, threatening, abusive, or otherwise objectionable
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use our services to compete with us or build a competing product
- Resell access to our platform without written authorization
5. SMS/Text Messaging Terms
Program Name: McGuire Management Notifications
Description: Transactional and informational SMS messages including appointment reminders, lead notifications, review requests, payment confirmations, and service updates.
Message Frequency: Message frequency varies based on your account activity and preferences.
Message and Data Rates: Message and data rates may apply. Check with your carrier for details.
Opt-Out: Reply STOP to any message to opt out of SMS notifications at any time.

Carriers: Carriers are not liable for delayed or undelivered messages.
6. Data Ownership
You retain all rights to the data you upload or enter into our platform. We do not claim ownership of your business data, contact lists, or communications. You grant us a limited license to process your data solely for the purpose of providing our services.
7. Intellectual Property
Our platform, including its design, features, code, and content, is owned by McGuire Management LLC and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our platform.
8. Third-Party Services
Our platform integrates with third-party services (e.g., payment processors, email providers, SMS carriers). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party service availability or performance.
9. Limitation of Liability
To the maximum extent permitted by law, McGuire Management LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our services.
10. Indemnification
You agree to indemnify and hold harmless McGuire Management LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
Either party may terminate the subscription at any time. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to use the platform ceases, and we may delete your account data after a reasonable retention period (typically 30 days).
12. Disclaimer of Warranties
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Hillsborough County, Florida.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through our platform. Continued use of our services after changes constitutes acceptance of the updated Terms.
